By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
BALLDONTLIE LLC provides sports data through an API for informational and analytical purposes only. We are not affiliated with, endorsed by, or connected to any professional sports leagues, teams, subsidiaries, or affiliates.
BALLDONTLIE LLC is NOT a gambling website, sportsbook, or wagering platform. We do not accept, facilitate, or process any bets, wagers, or gambling transactions of any kind. We do not provide gambling advice or recommendations. While our API may include betting odds data for informational purposes, this data is provided solely for research, analysis, and informational use. You acknowledge and agree that: (a) any decisions you make based on our data, including but not limited to wagering decisions, are made entirely at your own risk and discretion; (b) we bear no responsibility for any financial losses, gambling losses, or other damages resulting from your use of our data; (c) you are solely responsible for complying with all applicable gambling laws and regulations in your jurisdiction; and (d) we make no representations regarding the legality of gambling or sports betting in your jurisdiction.
To access our Services, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security. API keys are for your use only and may not be shared, sold, transferred, or distributed to third parties. Each API key is tied to a single account and must not be used across multiple applications or by multiple users without appropriate licensing.
You agree to: (a) use the Services solely for lawful purposes and in accordance with these Terms; (b) not use the Services in a way that could harm, disable, overburden, or impair our systems; (c) not attempt to gain unauthorized access to any part of the Services; (d) not use automated scripts to collect information from or interact with the Services except through our official API; (e) not resell, redistribute, or sublicense access to our API or data without express written permission; (f) comply with all applicable rate limits and usage restrictions associated with your subscription tier; and (g) not use the Services to build a competing product or service.
The sports data provided through the Services must not be: (a) used in connection with any illegal or unethical activities; (b) used in a way that suggests endorsement by or affiliation with any professional sports league, team, or organization; (c) presented as official league data or statistics; (d) cached, stored, or redistributed beyond reasonable application needs without our consent; or (e) used to create derivative databases for commercial resale. You retain responsibility for how you present and use data obtained through our Services in your applications.
ALL DATA PROVIDED THROUGH OUR SERVICES IS PROVIDED ON A "BEST EFFORT" BASIS AND SHOULD BE ACCEPTED "AS IS." While we strive to provide accurate and complete data, we expressly disclaim any guarantee, warranty, or representation regarding: (a) the accuracy, completeness, reliability, or correctness of any data; (b) the suitability of the data for any particular purpose; (c) the absence of errors, omissions, or inaccuracies in the data; or (d) the consistency of data across different endpoints or time periods. Data may contain errors, may be incomplete, and may be updated or corrected at any time without notice. You acknowledge that sports data can be inherently variable and that discrepancies may exist. You are solely responsible for validating any data before relying on it for critical decisions.
Any data described as "live," "real-time," or similar terms is provided on a BEST EFFORT BASIS ONLY. The definition of "live" varies and does not guarantee instantaneous or immediate data delivery. You acknowledge and agree that: (a) "live" data may be delayed by seconds, minutes, or longer depending on various factors including source availability, network conditions, and system load; (b) we make no guarantees regarding the latency, freshness, or timeliness of any data; (c) live data feeds may experience interruptions, delays, or temporary unavailability; (d) the refresh rate and update frequency of data may vary and is not guaranteed; and (e) you should not rely on our "live" data for time-critical applications where delays could result in harm or financial loss. We are not responsible for any losses or damages resulting from data delays or interruptions.
Access to certain features or levels of the Services may require payment of fees. We reserve the right to change our fees at any time with reasonable notice. All fees are non-refundable unless otherwise specified or required by applicable law. Subscription cancellations take effect immediately, not at the end of the billing period, and no prorated refunds will be issued for partial billing periods. You are responsible for all taxes associated with your use of the Services.
The Services, including all software, APIs, documentation, and related materials, are owned by BALLDONTLIE LLC and are protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Services in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of our software.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. We do not warrant that: (a) the Services will meet your specific requirements; (b) the Services will be uninterrupted, timely, secure, or error-free; (c) the results obtained from use of the Services will be accurate or reliable; (d) any errors in the Services will be corrected; or (e) the Services will be compatible with any particular hardware or software.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALLDONTLIE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR: (a) any indirect, incidental, special, consequential, punitive, or exemplary damages; (b) any loss of profits, revenue, data, goodwill, or other intangible losses; (c) any damages resulting from unauthorized access to or alteration of your data; (d) any damages resulting from interruption or cessation of Services; (e) any damages resulting from data inaccuracies or errors; (f) any gambling or wagering losses; or (g) any damages exceeding the total amount paid by you to us in the twelve (12) months preceding the claim. These limitations apply regardless of the legal theory on which the claim is based, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless BALLDONTLIE LLC and its officers, directors, employees, agents, suppliers, and licensors from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) your violation of any applicable laws or regulations; (e) any content or data you submit through the Services; or (f) any application or service you build using our API.
Our Services may integrate with or link to third-party services. We are not responsible for the availability, accuracy, or reliability of any third-party services. Changes to third-party services may affect our Services without prior notice. We make no representations or warranties regarding any third-party services or content.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Services without liability. We are not liable for any modification, suspension, or discontinuation of the Services.
We may suspend or terminate your access to the Services at our sole discretion, without prior notice, if you violate these Terms, if we suspect misuse of the data, or for any other reason. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any disputes arising under these Terms will be resolved exclusively in the state or federal courts located in New York, NY. You agree to submit to the personal jurisdiction of such courts. Any claim or cause of action arising out of or related to use of the Services must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us, constitute the entire agreement between you and BALLDONTLIE LLC regarding the Services. These Terms supersede any prior agreements or understandings, whether written or oral.
We reserve the right to update or modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website with a new "Last Updated" date. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Services.
